Terms and Conditions

1. Scope and acceptance

By accessing beinfer.com, creating an account in any Beinfer product, purchasing a subscription or credit pack, or otherwise using the Services, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Subscription Policy, Refund Policy and Disclaimer, each of which forms part of these Terms.

Individual Beinfer products may present additional product-specific terms at the point of sign-up or purchase. Where a product-specific term conflicts with these Terms, the product-specific term prevails for that product only.

If you do not agree to these Terms, you must not use the Services.

2. The Services

Beinfer designs, builds, publishes and promotes a portfolio of consumer products. Depending on the product, the Services may include:

• AI video and photo generation: tools that generate or edit images and short video clips from text prompts, uploaded photos or reference media.
• AI chat and model comparison: tools that send a prompt to one or more third-party or self-hosted language models and display the responses, including side by side.
• AI deep research: tools that run multi-step research tasks across public sources and return summarised reports with references.
• AI language learning: conversation-led practice, correction and exercises delivered with the help of AI models.
• Mobile games: casual games distributed through mobile application marketplaces.
• Video tutorials: instructional video content on yoga, wellbeing and beauty topics.

Not every product is available in every country, on every platform or at every time. We may add, change, suspend or discontinue any product or feature as described in Section 11.

3. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your country of residence if higher, to purchase any paid Service. Where a product is made available to younger users, the product-specific terms and the applicable marketplace rules state the minimum age and any parental consent required.

When you create an account you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us at support@beinfer.com immediately if you believe your account has been accessed without authorisation.

We may refuse registration, or suspend or close an account, where we reasonably believe these Terms have been breached, where required by law, or where an account has been inactive for an extended period after notice to you.

4. Subscriptions, credits and payment

Some Services are free. Others are offered as recurring subscriptions, one-off purchases or consumable credit packs. The price, billing period, what is included and the currency are displayed before you confirm any purchase.

Payment is collected through the payment method offered in the relevant product, which may include card payments, application marketplace billing (Google Play, Apple App Store) or other authorised billing partners. Where a third-party marketplace processes your payment, that marketplace's terms also apply to the transaction and any refund handled by it.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Renewal, cancellation and price-change rules are set out in the Subscription Policy. Refund eligibility is set out in the Refund Policy.

Prices may include or exclude applicable taxes depending on your location; where taxes are added at checkout, the total is shown before you confirm.

5. Acceptable use

You agree to use the Services only for lawful purposes and in accordance with these Terms. In particular, you must not:

• generate, upload or distribute content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or that infringes the rights of any person;
• use the Services to create deceptive media of real people without their consent, or to impersonate any person or organisation;
• upload photographs or media of any person without the right to do so;
• attempt to bypass usage limits, content safeguards, geographic restrictions or payment mechanisms;
• reverse engineer, scrape, crawl or extract data from the Services except as permitted by law or by an explicit written licence;
• resell, sublicense or commercially exploit the Services or any output where the product-specific terms do not permit it;
• interfere with the operation or security of the Services or of any network connected to them.

We may remove content, limit features or suspend accounts that we reasonably believe breach this Section.

6. Your content and AI outputs

6.1 Your inputs

You retain any rights you hold in the text, images, audio, video and other material you submit to the Services ("Inputs"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and transmit your Inputs solely to the extent necessary to provide, secure and improve the Services, and to comply with law. You are responsible for ensuring you have all rights and consents needed to submit your Inputs.

6.2 Outputs

Subject to your compliance with these Terms and payment of any applicable fees, we assign to you any rights we may hold in the images, video, text and other material generated for you by the Services ("Outputs"), to the extent permitted by law. Because generative systems are probabilistic, Outputs may not be unique, and other users may receive identical or similar Outputs from similar Inputs. We make no representation that any Output is free of third-party rights, is accurate, or is fit for a particular purpose.

6.3 Responsibility

You are solely responsible for how you use Outputs, including for verifying facts contained in AI-generated text and for obtaining any consents or licences required for publication. Content produced with AI should be identified as such where the law or a platform on which you publish it requires.

6.4 Service improvement

We may use aggregated and de-identified usage data to improve the Services. We do not use your Inputs or Outputs to train AI models unless a product explicitly asks for and receives your consent to do so.

7. Intellectual property

The Services, including software, design, text, graphics, logos, the Beinfer name and mark, and all related intellectual property, are owned by or licensed to Visatech S.R.L. Nothing in these Terms grants you any right to use the Beinfer name, logo or trade dress without our prior written consent.

If you believe content available through the Services infringes your rights, write to support@beinfer.com with a description of the work, the location of the allegedly infringing material, your contact details and a statement of good-faith belief. We will review every notice and act where appropriate.

8. Third-party services and models

The Services rely on third-party infrastructure and, for AI features, on models operated by third-party providers as well as on models we host ourselves. When you use a feature that routes your request to a third-party model, your Inputs are transmitted to that provider for processing under a data protection agreement, as described in our Privacy Policy. We are not responsible for the content of third-party websites, applications or services linked from the Services.

9. Health, wellbeing and learning content

Yoga, wellbeing and beauty tutorials are provided for general information and personal practice only. They are not medical, dermatological or professional advice and are not a substitute for consultation with a qualified practitioner. Consult a doctor before starting any exercise programme, and stop if you feel pain or discomfort. Language-learning products support practice and do not confer any accredited qualification. See the Disclaimer.

10. Mobile applications

Where a Service is delivered as a mobile application, your use is additionally subject to the terms of the marketplace from which you downloaded it. Marketplace operators are not party to these Terms and have no obligation to provide support for the Services. Some applications may be published under the name of an affiliated publishing entity; the Services remain operated by the Company and governed by these Terms regardless of the publisher of record shown in a marketplace listing.

11. Availability and changes to the Services

We aim to keep the Services available at all times but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Services, including AI models, features and content libraries, at any time. Where a change materially reduces a paid Service during a billing period you have already paid for, you may be entitled to a pro-rated refund as set out in the Refund Policy.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Services and all Outputs are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in this Section limits the statutory guarantees that consumer law in your country grants you and that cannot be excluded by contract.

13. Limitation of liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with the Services or any Output. Our total aggregate liability for all claims arising in any twelve-month period shall not exceed the amount you paid to us for the Services in that period, or one hundred euro (EUR 100) if you paid nothing.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law.

14. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the Company and its officers, employees and contractors from any claim, loss or expense (including reasonable legal fees) arising from your Inputs, your use of Outputs, or your breach of these Terms. This Section does not apply to consumers to the extent that local consumer law prohibits such indemnities.

15. Suspension and termination

You may stop using the Services and close your account at any time through the product's account settings or by writing to support@beinfer.com. We may suspend or terminate your access where you breach these Terms, where required by law, or where continued provision becomes commercially or technically unreasonable, in which case we will refund any prepaid fees for the unused period unless termination results from your breach. Sections 6 to 8 and 12 to 17 survive termination.

16. Governing law and disputes

These Terms are governed by the laws of Italy. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Milan, Italy, except that if you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law grants you the right to bring proceedings in your own country, nothing in this Section deprives you of that right or of the protection of the mandatory provisions of the law of your country of residence.

17. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page identifies the current version. Material changes will be announced by email or by a notice inside the affected product at least fifteen (15) days before they take effect, unless a shorter period is required by law or by the nature of the change. Continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not accept a change, you may cancel your subscription before it takes effect.
